DMCA & Creator Opt-Out Policy

1. Overview
Wayn Corporation (“Wayn,” “we”) respects the intellectual property rights of others and complies with the U.S. Digital Millennium Copyright Act (“DMCA”). This Policy explains how to submit a copyright infringement notice or a counter-notice regarding content displayed through the Lume mobile applications and websites (the “Service”), and it also describes Lume’s separate Creator Channel Opt-Out process for YouTube creators who do not want their channel surfaced through Lume.
2. Important Note About YouTube-Hosted Content
Lume does not host or store the underlying YouTube videos. Videos are hosted by YouTube, LLC and are displayed through YouTube’s official embedded player. The primary point of contact for copyright concerns regarding the underlying video itself is YouTube, not Lume. YouTube provides its own copyright complaint process at https://www.youtube.com/copyright_complaint_form.
If your concern is that a video should not be discoverable or surfaced through Lume specifically — even if the underlying video remains on YouTube — please follow the DMCA notice procedure in Section 3, or the Creator Opt-Out procedure in Section 5, as applicable.
3. How to Submit a DMCA Notice to Wayn
If you believe in good faith that content displayed or surfaced through the Service infringes your copyright, you may submit a written notice that includes all of the following information required by 17 U.S.C. § 512(c)(3):
1. A physical or electronic signature of the copyright owner or a person authorized to act on the owner’s behalf;
2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works;
3. Identification of the material that is claimed to be infringing and that is to be removed or access to which is to be disabled, with sufficient information to enable Wayn to locate the material (for the Service, this typically includes the YouTube video URL and a description of where in the Service the material appears);
4. Information reasonably sufficient to permit Wayn to contact the complaining party, such as an address, telephone number, and (if available) an email address;
5. A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
6. A statement that the information in the notification is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Notices may be submitted by email to the address above. We may also accept notices by mail; contact us by email to request a mailing address.
Misuse warning. Section 512(f) of the DMCA imposes liability on persons who knowingly and materially misrepresent that material is infringing. Please do not submit a DMCA notice unless you are the copyright owner or are authorized to act on the owner’s behalf and you have a good-faith belief that the use complained of is not authorized.
4. Counter-Notice
If you believe that material you posted or that you control was removed or disabled in error or misidentification, you may submit a written counter-notice to our Designated Copyright Agent that includes:
1. Your physical or electronic signature;
2. Identification of the material that was removed or to which access was disabled and the location at which the material appeared before it was removed or access disabled;
3. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled;
4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or, if your address is outside the United States, the federal district court for the District of Delaware, and that you will accept service of process from the person who provided the original notification or an agent of that person.
We will forward any counter-notice we receive to the party who submitted the original DMCA notice, and we may restore the disputed material in accordance with the procedures set out in 17 U.S.C. § 512(g).
5. Repeat Infringers
Wayn maintains a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers of copyright.
6. Creator Channel Opt-Out
Separately from the DMCA process, Lume offers a Creator Channel Opt-Out for YouTube creators who do not want their channel or videos surfaced through Lume’s curation. Opt-out is honored regardless of whether the request raises a legal claim — it is offered as a courtesy to creators.
Who may submit a Creator Opt-Out request. The verified owner or authorized representative of a YouTube channel may request that Lume stop surfacing the channel and its videos.
How to submit. Send a request to connect@wayn.co with the following information:
1. The full URL of the YouTube channel for which you are requesting opt-out;
2. Your name, role, and email contact;
3. A brief statement confirming you are the channel owner or authorized representative of the channel owner (we may request reasonable verification, such as a confirmation email sent from the channel’s contact email on file or a confirmation posted from the channel’s verified account);
4. (Optional) A reason for the request, so we can improve our curation.
Response timeline. We aim to acknowledge Creator Opt-Out requests within 2 business days and to remove the channel from Lume’s curation within 7 calendar days of verifying the request. Removal applies to discovery, search, recommendations, and category surfaces within Lume. Because the underlying videos remain on YouTube, they continue to be accessible there.
Scope of removal. Opt-out removes the channel from Lume’s surfaces going forward. Cached metadata in Lume’s systems is purged on the next scheduled refresh cycle (in any case within 30 days, in accordance with Lume’s data retention practices).
Re-inclusion. A creator who has previously opted out and later wishes to be included again may contact connect@wayn.co to request re-inclusion. Lume’s curation team will review the request in the normal course.
7. Notice of Changes to this Policy
We may update this Policy from time to time. The current version is always available at https://www.wayn.co/lume-dmca . The “Effective Date” above will be updated whenever the Policy changes.
